Terms & Conditions


This Ambera Priority Reservation Agreement (the “Agreement”) is concluded between you as the applicant acquiring an Ambera Priority Reservation (“You”), and Ambera Lifestyle AS, business reg. no. NO 924 862 521, Klingenberggata 7b, 0161 Oslo, Norway (“Ambera”). This Agreement describes Your rights and obligations related to Your Ambera Priority Reservation (“Reservation”). The Reservation does not bind You to any further obligations than the initial payment of a reservation fee (“Reservation Payment”) in connection with Ambera’s Priority Reservation campaign.

These Terms & Conditions are effective as of the date you place your Reservation and make your Reservation Payment (the “Reservation Date”).

Priority Reservation and Membership in the Ambera Lifestyle Organisation

By entering into this Agreement, You get the preferred right (“Reservation”) to purchase an Ambera home (the “Home”) when you make your Reservation. The order in which Reservations can be exercised will be defined by the time you make your Reservation (“first come – first served”-principle).

An actual Home purchase transaction will be completed on Your request when new Ambera homes become available for purchase from Ambera Lifestyle AS or its affiliates (“We” or “Our”). Homes will be priced and configured based on locations, sizes, features and options available at the time of order, and you can confirm availability with an Ambera representative.

By entering into this Agreement, You simultaneously become a lifetime member of the Ambera Lifestyle organisation. Membership is free and places no onus or obligation upon You.

Membership of the Ambera Lifestyle organisation confers several benefits, none of which are predicated on the purchase of a home. Ambera Lifestyle organisation members (“Members”) gain lifetime access to the Ambera Life mobile App (“App”) after the App releases to the general public. Members will be given unique opportunities to meet and bond with other Members. These opportunities are neither obligatory, nor contingent on a home purchase (effectively allowing Members to “try the community before you buy”). There are no restrictions or limitations on how many opportunities can be taken, but some may run at a cost. More details will follow within the App on a per-case basis. Furthermore, Members can enjoy preferential treatment at any Ambera community currently developed, in development, or that is developed in the future. Members will be informed via their preferred communications channel as more benefits become available.

Price, Taxes and Official Fees

The price of the Home will be confirmed in Your Home Configuration, which describes the home that you configure, and the Final Price Sheet once they become available, which both will form a part of the purchase agreement for Your Home. As Ambera communities will eventually be developed in various countries, any price listed in the Home Configuration will not include taxes and official or government fees, which could amount to up to 20% or more of the Home price. Because these taxes and fees are constantly changing and will depend on many factors, they will be calculated closer to the time of purchase and indicated on Your Final Price Sheet. You are responsible for paying these additional taxes and fees.

Priority Access, Reservation Process, Cancellation and Refund

Once You have received Your Priority Reservation and homes become available for sale, You have priority access to choose one home based on the time You made Your Reservation, and We will invite You to complete the configuration of Your Home. We will then issue You the Home Configuration and Final Price Sheet based on the base price of the home and any options included or that you select.

Your Reservation Payment covers Your Priority Reservation and is not a deposit for a Home. You may cancel Your Reservation within 14 days after the date this Agreement is concluded, in which case You will receive a full refund of Your Reservation Payment. Such cancellation will also result in termination of your membership in the Ambera Lifestyle organisation, as membership, while free, is contingent upon holding or using a reservation.

If You received Your reservation for free as part of a special offer, promotion, referral, or any other means permitted by Ambera, You are not entitled to any monetary reimbursement. Your other rights remain unchanged.

When You sign the purchase agreement for Your Home, You consume Your Priority Reservation. However, You remain a Member of the Ambera Lifestyle organisation, which is free of charge, until You unsubscribe.

The Reservation and this Agreement are not made or entered into in anticipation of or pending any conditional purchase contract.

You understand that Ambera may not have completed the development of home types or begun construction of homes at the time You entered into this Agreement, and Ambera will not have an obligation to deliver a home until an actual home purchase agreement has been signed and closed. Your actual delivery date is dependent on many factors, including, but not limited to, Your future Home’s location, configuration and available construction capacity.

Limitation of Liability

We are not liable for any incidental, special or consequential damages arising out of this Agreement. Your sole and exclusive remedy under this Agreement will be limited to reimbursement of your Reservation Payment. If no payment was made (see Section 4 of this agreement), You are entitled to no reimbursement.

No Resellers, Discontinuation and Cancellation

Ambera and its affiliates sell homes directly to end-consumers, and we may unilaterally cancel any order that we believe has been made with a view toward resale of the Home or that has otherwise been made in bad faith.

Governing Law, Integration and Assignment

The terms of this Agreement are governed by, and are to be interpreted according to, Norwegian law. Prior agreements, oral statements, negotiations, communications or representations about the Home to be sold in exercise of this Agreement are superseded by this Agreement. Terms relating to the Reservation not expressly contained herein are not binding. We may assign this Agreement at Our discretion to one of Our affiliated entities. Any home purchase agreement will be governed by the laws agreed therein.

This Agreement is entered into and effective as of the date you accept this Agreement, by electronic means or otherwise. By confirming and accepting this Agreement, you agree to the Terms & Conditions of this Agreement.
